Terms and Conditions

INTERPRETATION

In these conditions (“Conditions”) “We”, “Us” or “Our” means ELEPHANT DRIVING SCHOOL LIMITED (The) (company registration number: 08875488) and “You” or “Your” means the customer.

You must read these Conditions in full as they set out our complete Terms upon which We have agreed to provide, and You have agreed to Obtain, driving tuition from Us. We and Your Instructor reserve the right to charge for any lessons affected by Your failure to comply with any of these Conditions.

1. YOUR INSTRUCTOR AND ELEPHANT DRIVING SCHOOL

  • 1.1 Your instructor is a self-employed franchisee (‘your instructor’) of Elephant Driving School Limited (‘Elephant Driving School’, ‘we’, ‘us’, ‘our’)
  • 1.2 No contractual liability shall arise or subsist between you and us; however we will endeavour to assist you with your requirement.

2. DRIVING LICENCES AND FITNESS TO DRIVE

  • 2.1 You must hold a current, valid driving licence, provisional, full or international, and produce it on (or in advance of) your first driving lesson. You must be fit to drive with regard to legal and medical requirements.
  • 2.2 Your eyesight must be up to standard. If you are unable to read a number plate from the required distance, the instructor may refuse to allow you to drive. It is advisable to have your eyesight checked before beginning any course.

3. YOUR INSTRUCTOR’S RESPONSIBILITIES

  • 3.1 Your instructor will behave in a professional manner towards you, as per the Driver and Vehicle Standards Agency’s (DVSA) Code of Practice for Approved Driving Instructors.
  • 3.2 Your instructor agrees to abide by the conditions of the Professional Code of Conduct (a copy of which will be provided on request).
  • 3.3 Your instructor will be responsible to maintain his vehicle in a clean, roadworthy condition as required by law.
  • 3.4 Your instructor will provide a vehicle fitted with dual-controls, and learner driver livery.

4. INSURANCE

  • 4.1 Your instructor will carry the appropriate motor insurance, should you be involved in a collision as a learner driver while in control of driving the instructor’s tuition vehicle.
  • 4.2 Your instructor will provide a vehicle that is fully taxed and insured for tuition and practical driving test purposes.

5. LESSONS PRICES

  • 5.1 First introductory offers cannot be used in conjunction with other offers and are not transferable.
  • 5.2 Prices are correct as of April 2025. Although we strive to remain competitive with our pricing, we reserve the right to alter the pricing structure without prior notice. Subsequent lesson price will then be charged according to the new pricing structure. Any outstanding pre-paid lessons will be honoured at the original price paid.
  • 5.3 Payment for tuition shall be made cash or Bank transfer direct to the Instructor. You must obtain a receipt from your Instructor.
  • 5.4 Lessons will be on a one-to-one basis, unless otherwise agreed by all parties concerned.
  • 5.5 Duration of each lesson is 2 hours.
  • 5.6 All the prices include weekends, evening, weekdays and bank holidays.
  • 5.7 Pay as you take lesson prices are £37.50 for a manual car and £37.50 for an automatic car, motorway or advanced driving lessons not included.
  • 5.8 If you are not in contact with the instructor for more than 6 months will lose any advanced payments.

6. INTENSIVE DRIVING COURSES

  • 6.1 Intensive driving courses do not include the charges of theory test, the hire of car on the test day, neither the practical driving test fee.
  • 6.2 Intensive driving course must be taken within 6 months of the purchase date. Outwith that time period, the lessons will be lost.
  • 6.3 All intensive driving course cancellations will have the balance refunded in full. As intensive driving course bookings incorporate a discount on full lesson price, the monies returned on cancellation will be proportional to the amount paid.
  • 6.4 If you are not in contact with the instructor for more than 6 months will lose any advanced payments.

7. BLOCK BOOKINGS

  • 7.1 Block booking lessons must be taken within 6 months of the purchase date. Outwith that time period, the lessons will be lost.
  • 7.2 Block booking discounts only valid when pay in advance and does not include driving test fee neither the hire of car on the test day.
  • 7.3 All block booking cancellations will have the balance refunded in full. As block bookings incorporate a discount on full lesson price, the monies returned on cancellation will be proportional to the amount paid.
  • 7.4 If you are not in contact with the instructor for more than 6 weeks will lose any advanced payments.
  • 7.5 If you choose to cancel your block booking lessons after attending some sessions, the refund will be calculated at a rate of £47.50 per hour.

8. PASS PLUS COURSE

  • 8.1 Pass Plus course contain minimum of 6 hours. PassPlus certificate only applied when minimum of 6 hours are completed.

9. TRAINING LOCATION

  • 9.1 All sessions will start and finish at the same location unless alternative arrangements are made in advance. Your instructor will determine a location for practical lessons which ensures bothyour and public safety.
  • 9.2 Until your instructor determines that your skill level enables you to drive safely from the starting location, this may mean that your instructor will drive you to a safe location. The time taken to do this will be part of the lesson time.

10. YOUR RESPONSIBILITIES

  • 10.1 Angry and aggressive behaviour will not be tolerated in the car at any time. Any such behaviour will result in the lesson being stopped, and you being dropped off immediately. You will be charged for the full lesson.
  • 10.2 If you are suspected of being under the influence of alcohol, illegal substances or drugs (prescribed or otherwise), whereby your judgement and responses may be impaired, will be dropped off immediately. You will be charged for the full lesson and any prepaid lessons will not be refunded.
  • 10.3 The instructor’s telephone number should be saved under ‘Driving Instructor’ to reduce the risk of inadvertent texting/calling.
  • 10.4 If, for any reason, you have to text your instructor, then all text communication should be easily understandable, without common text abbreviations and substitutes, and should be polite and formal in tone, as befits the professional relationship between you and your instructor.
  • 10.5 Any changes to pick up/drop off points should be arranged at least 24 hours prior to the lesson. Any extra travel time, to any such points, will be part of the lesson time.
  • 10.6 If you require tuition in your own vehicle (e.g. Pass Plus/refresher lessons), you must supply evidence that your vehicle is fully taxed, MOT’d and insured.
  • 10.7 You are agreeing to refrain from smoking in the tuition vehicle at all times.
  • 10.8 You are agreeing to refrain from consuming food or drink in the tuition vehicle without the prior consent of your Instructor.
  • 10.9 You are agreeing that it is your responsibility to provide all relevant documentation required when taking your theory and practical driving tests. Neither The Elephant Driving School Limited nor your Instructor accepts any responsibility for any losses caused by failure to provide this documentation.

11. LATENESS

  • 11.1 Your instructor will endeavour to be on time always. In the event of any lateness, your instructor will contact you to confirm the new start time.
  • 11.2 If your instructor is going to be more than 20 minutes late you may opt to reschedule your lesson if necessary.

12. CANCELLATIONS POLICY

  • 12.1 If you wish to cancel a lesson, a minimum of 48 hours prior notice should be given. Full fee will be charged if cancellation is under 48 hours. Please note that all cancellations must be communicated between you and your Instructor or vice versa. Elephant Driving School Ltd is unable to pass on cancellation information.
  • 12.2 Cancelling of lessons must be arranged through a SMS Text or email to your Instructor in order to organise the next appointment more easily.
  • 12.3 If your instructor cancels the lesson due to either illness, mechanical fault or unforeseen circumstances outwit your instructor’s control, another time will be offered either for the same day, or for an alternative date and time, suitable to both parties, within the same week. If no alternative date and time within the same week can be arranged, a lesson will be arranged for the following week.
  • 12.4 Your instructor cannot be held responsible for cancelled lessons due to bad weather.
  • 12.5 In the event that you do not show up for the lesson, your instructor will wait for 15 minutes before leaving. The lesson will then be presumed cancelled and you must pay for the lesson.

13. PRACTICAL DRIVING TESTS

  • 13.1 When attending a driving test, a minimum of three hours will be required which include one hour drive prior to the test, one hour for the test, and one hour to get the candidate home and, therefore, fixed fee will be applied to accommodate the use of the learner vehicle for the test.
  • 13.2 Hire a car for the practical driving test fee is £145 for manual car and £145 for automatic car. The hire of car on test day price are correct as of April 2025. Although we strive to remain competitive with our pricing, Elephant Driving School reserve the right to alter the pricing structure without prior notice. Subsequent hire a car for practical fee will then be charged according to the new pricing structure. Any outstanding pre-paid, will be honoured at the original price paid.
  • 13.3 The hire of car on test day price does not include extended driving test.
  • 13.4 Your instructor is not responsible for tests cancelled by the DVSA due to strike action, road conditions in bad weather, or staff sickness. Hire a car for the practical driving test fee will still be chargeable. Your instructor will advise you as to whether, and how, to claim compensation from the DVSA.
  • 13.5 If you fail to take regular lessons between a test being booked and the test date, your instructor reserves the right to withdraw the use of the learner vehicle for driving test purposes.
  • 13.6 In the unlikely event that you book your own driving test, your instructor must be notified of the date and time of any tests at least 14 days prior to the test date to ensure that yourinstructor’s vehicle is available for the test and to avoid the risk of double-bookings.
  • 13.7 Your instructor reserves the right to withdraw the use of the learner vehicle for driving tests if your instructor deems that you are not yet ready for test and it would, therefore, be unsafe for you, examiner or other road users if you were to sit your test at that time and Elephant Driving School Ltd does not accept any responsibility for this decision.

14. YOUR PHOTOGRAPH

  • 14.1 Your instructor will ask you for a photographor video when you have passed your driving test. By agreeing to this, you are allowing us to use the photograph in our testimonials section and possibly elsewhere as promotional material.

15. FEEDBACK

  • 15.1 You will be given the opportunity to complete a feedback form in relation to the driving course. This feedback will contain questions relating to the service provided by your instructor. This feedback will be recorded and used to measure the effect of the driving course and the performance of your instructor. Your instructor will be given a feedback on performance at regular intervals.

16. COMPLAINTS PROCEDURE

  • 16.1 In the unlikely event of complaint or dispute the guidelines of the Code of Conduct will be adhered to at: https://www.gov.uk/guidance/adi-voluntary-code-of-practic.
  • 16.2 In the rare event of any problem arising, you should resolve this with your instructor immediately. We recommend no further lessons are taken until the matter is resolved.

  • 16.4 We aim to resolve complaints within 5 working days, in some instances we may ask for the complaint tobe sent in writing, any requests sent in writing we will try to resolve within 28 working days.
  • 16.5 If you still feel dissatisfied, you may contact the Driver and Vehicle Standards Agency on 0300 200 1122 who may be able to help you further.

17. PRIVACY

  • 17.1 We are committed to protecting your privacy. We will only use the information that we collect about you lawfully – in accordance with the Data Protection act 1998
  • 17.2 Any personal information which we hold to process your booking will be held securely in accordance with the law, and will not be sold or passed on to a third party.

18. LEGAL LIABILITY

  • 18.1 Your instructor will make every effort to train you to the highest standard but can in no way be held liable for any errors you may make before, during and after passing a practical driving test.

19. YOUR RIGHTS

  • 19.1 These conditions do not affect any protection you have under consumer legislation.
  • 19.2 We reserve the right to change or alter any of the terms and conditions without notice, but will endeavour to inform pupils of any changes as soon as possible.
